use pics in a youtube video?
Posted on: 07/20/12 11:27AM

hi there.
i really love Gelbooru. so i want to ask the friendly way before simply stealing stuff.

there are some cute looking pic that are far away from being anything pornographic or something like that.
i would love to show those pics to others on youtube. but i am afraid to violate any copyright.
are there any rules for distributing Gelbooru stuff somewhere else?
are the pics creative commons?
do i have to ask each single artist?
and for asking the artist: i bet lots of people upload stuff to Gelbooru, even if they dont own the rights for it.

or would you simply say i should take any pic i want, as long as i am linking to the original Gelbooru image? (i guess not. because when it's not creative commons, this would e a copyright violation, i think)

Everything on Gelbooru is taken from freely available sources. As long as you aren't making a profit from it than any use is fair use, even those images sourced from outside your country. People put them on YouTube all the time. If the video is taken down it is usually because the music was licensed in your country.

Gelbooru is not really a source for anything you see here. We are only a gallery of images that are/once where available freely elsewhere on the internet. Most of the artists involved probably don't even know Gelbooru exists.

are there any rules for distributing Gelbooru stuff somewhere else? - None that I know of.
are the pics creative commons? - International copyright law still applies but this material is more "Fair use" than creative commons. As long as you don't take credit for the work (except any editing you do) or make a profit from it you should be good.
do i have to ask each single artist? - I wouldn't say "have to". You can if you want to and can speak in Japanese.
and for asking the artist: i bet lots of people upload stuff to Gelbooru, even if they don't own the rights for it. - [Almost] none of the works here where posted by the original artist. This is not pixiv or Deviantart. People post other peoples work here as the norm.

or would you simply say i should take any pic i want, as long as i am linking to the original Gelbooru image? - Most of the images are sourced from pixiv. Again, Gelbooru is not really a source for anything.

"as long as you aren't making a profit from it"
well, that might be a problem, depending on how you define "making profit"
my channel is a youtube partner channel. So generally there are ads shown wich generade a small amount of money.
some people would call that making profit, some people dont ...

and even if the video itself wouldn't generate any money from those ads, it would make people find my channel, watch other videos, and make some profit the other way ....
so it always depends on the definition of things.

I'd say that doesn't count.

Even Gelbooru is profiting from these images through advertisements. The entire internet is.

As to whether that is considered legal or not I have no idea. Then again, our favorite source tends to be Pixiv or artist blogs where images are posted for free in the first place.

Jedi is off on the Fair Use thing as you're taking people's work whole cloth, so it's copyright infringement. The thing of it is no one will know or care. Just like Gelbooru, our existence is based on copyright infringement. The least you could do though is give credit every artist who's work you use. I don't mean "Dis ain't my work, do do do," I mean artist names/handles and links to something of theirs, blogs, pixiv pages, ect.

Really though I would discourage doing this because these videos are awful.
