actually he did not due a comic issue...in the comic he did NOT appear in the avengers. He will join the new avengers and it MAYBE apprear in the second movie. And on top of that spidey is Sony's propriety. So Marvel has to buy him back to make a movie. So it's not even sure if he will be in the second movie.
